A dramatic shift in British and French ideas about empire unfolded in the sixty years straddling the turn of the nineteenth century. As Jennifer Pitts shows in A Turn to Empire, Adam Smith, Edmund Burke, and Jeremy Bentham were among many at the start of this period to criticize European empires as unjust as well as politically and economically disastrous for the conquering nations. By the mid-nineteenth century, however, the most prominent British and French liberal thinkers, including John (...) class='Hi'>Stuart Mill and Alexis de Tocqueville, vigorously supported the conquest of non-European peoples. Pitts explains that this reflected a rise in civilizational self-confidence, as theories of human progress became more triumphalist, less nuanced, and less tolerant of cultural difference. At the same time, imperial expansion abroad came to be seen as a political project that might assist the emergence of stable liberal democracies within Europe. Pitts shows that liberal thinkers usually celebrated for respecting not only human equality and liberty but also pluralism supported an inegalitarian and decidedly nonhumanitarian international politics. Yet such moments represent not a necessary feature of liberal thought but a striking departure from views shared by precisely those late-eighteenth-century thinkers whom Mill and Tocqueville saw as their forebears. More than 25 years into the HIV epidemic, in excess of 2 million new infections continue to occur each year. HIV prevention research is crucial for groups at heightened risk for HIV, but the design and conduct of HIV prevention research with vulnerable populations worldwide raises considerable ethical challenges. The HIV Prevention Trials Network (HPTN) is a global collaborative network that conducts clinical and behavioural studies on non-vaccine interventions to reduce the transmission of HIV. In 2003, the HPTN developed ethical (...) guidance to enhance the responsible conduct of its research activities and as a distinctive contribution to global research ethics. In what follows, the developments that motivated the drafting of a revised ethics document in 2009 are described, including the process by which that revision took place and some of the key differences between the HPTN ethics guidance and other relevant guidelines in the field. It is now more than ten years since the EU FET project ALFEBIITE finished, during which its researchers made original and distinctive contributions to (inter alia) formal models of trust, model-checking, and action logics. ALFEBIITE was also a highly inter-disciplinary project, with partners from computer science, philosophy, cognitive science and law. In this paper, we reflect on the interaction between computer scientists and information and IT lawyers on the idea of the ‘open agent society’. This inspired a programme of research (...) whose investigation into conceptual challenges has carried it from the logical specification of agent societies and dynamic norm-governed systems to self-organising electronic institutions, while developing several technologies for agent-based modelling and complex event recognition. The outcomes of this inter-disciplinary collaboration have also influenced current research into using the open agent society as a platform for socio-technical systems, and other collective adaptive systems. We present a number of research challenges, including the ideas of computational justice and polycentric governance, and explore a number of ethical, legal and social implications. We contend that, in order to address these issues and challenges, the continued inter-disciplinary collaboration between computer science and IT lawyers is critical. (shrink)

A thematic priority of the European Union’s Framework V research and development programme was the creation of a user-friendly information society which met the needs of citizens and enterprises. In practice, though, for example in the case of on-line digital music, the needs of citizens and enterprises may be in conflict. This paper proposes to leverage the appearance of ‘intelligence’ in the platform layer of a layered communications architecture to avoid such conflicts in similar applications in the future. The key (...) idea is that if the intelligence is encapsulated in an agent, then the agents should be organized as a society, and then the rules of the society can be used to ensure ‘responsible’ behaviour. We discuss how an agent society can be used to regulate behaviour in future information trading scenarios, and conclude that this approach offers a ‘third way’ which can satisfy the (reasonable) needs of both citizens and enterprises in the user-friendly information society. Cloud computing deals with voluminous heterogeneous data, and there is a need to effectively distribute the load across clusters of nodes to achieve optimal performance in terms of resource usage, throughput, response time, reliability, fault tolerance, and so on. The swarm intelligence methodologies use artificial intelligence to solve computationally challenging problems like load balancing, scheduling, and resource allocation at finite time intervals. In literature, sufficient works are being carried out to address load balancing problem in the cloud using traditional swarm (...) intelligence techniques like ant colony optimization, particle swarm optimization, cuckoo search, bat optimization, and so on. But the traditional swarm intelligence techniques have issues with respect to convergence rate, arriving at the global optimum solution, complexity in implementation and scalability, which limits the applicability of such techniques in cloud domain. In this paper, we look into performance modeling aspects of some of the recent competitive swarm artificial intelligence based techniques like the whale, spider, dragonfly, and raven which are used for load balancing in the cloud. The results and analysis are presented over performance metrics such as total execution time, response time, resource utilization rate, and throughput achieved, and it is found that the performance of the raven roosting algorithm is high compared to other techniques. Many open networks, distributed computing systems, and infrastructure management systems face a common problem: how to distribute a collectivised set of resources amongst a set of autonomous agents of heterogenous provenance. One approach is for the agents themselves to self-organise the allocation of resources with respect to a set of agreed conventional rules; but given an allocation scheme which maps resources to those agents and a set of rules for determining that allocation scheme, some natural questions arise—Is this allocation fair? (...) Is the allocation method effective? Is it efficient? Are the decision makers accountable? In this paper, we argue that some answers to these questions can be found in the formal characterisation of different aspects of ‘justice’ and that these different aspects need a principled operationalisation as policies for system management. We present a formal model and some experimental results, concluding that the different aspects are all inter-connected and that what is required is a comprehensive research programme in computational justice. Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. BackgroundCritical public health measures implemented to mitigate the spread of the novel coronavirus disease (COVID-19) pandemic have disrupted health research worldwide, including HIV prevention research. While general guidance has been issued for the responsible conduct of research in these challenging circumstances, the contours of the dueling COVID-19 and HIV/aids pandemics raise some critical ethical issues for HIV prevention research. In this paper, we use the recently updated HIV Prevention Trials Network (HPTN) Ethics Guidance Document (EGD) to situate and analyze key (...) ethical challenges related to the conduct of HIV prevention research during the COVID-19 pandemic as well as identify potential areas for refinement of the guidance document based on this unprecedented state of affairs.Main bodyNecessary actions taken for HIV prevention research studies due to the COVID-19 pandemic involve an array of ethical issues including those related to: (1) risk mitigation; (2) behavior change; (3) compounding vulnerability; (4) community engagement; (5) trial reopening; and 6) shifting research priorities.ConclusionsIn the context of the dueling HIV and COVID-19 global pandemics, research teams and sponsors must be nimble in responding to the rapidly changing environment by being sensitive to the associated ethical issues. The HTPN EGD provides a rich set of tools to help identify, analyze and address many of these issues. At the same time, future refinements of the HPTN EGD and other research ethics guidance could be strengthened by providing explicit advice regarding the ethical issues associated with disrupted research and the reopening of studies. In addition, additional consideration should be given to appropriately balancing domains of risk (e.g., physical versus social), addressing the vulnerability of research staff and community partners, and responding to un-anticipatable ancillary care needs of participants and communities. Appropriately addressing these issues will necessitate conceptual work, which would benefit from the careful documentation of the actual ethical issues encountered in research, the strategies implemented to overcome them, and their success in doing so. Throughout all of these efforts, it is critical to remember that the HIV pandemic not be forgotten in the rush to deal with the COVID-19 pandemic. (shrink)

A challenge of performing research in the paediatric emergency and acute care setting is obtaining valid prospective informed consent from parents. The ethical issues are complex, and it is important to consider the perspective of participants, health care workers and researchers on research without prospective informed consent while planning this type of research. We performed a systematic review according to PRISMA guidelines, of empirical evidence relating to the process, experiences and acceptability of alternatives to prospective informed consent, in the paediatric (...) emergency or acute care setting. Major medical databases and grey sources were searched and results were screened and assessed against eligibility criteria by 2 authors, and full text articles of relevant studies obtained. Data were extracted onto data collection forms and imported into data management software for analysis. Thirteen studies were included in the review consisting of nine full text articles and four abstracts. Given the heterogeneity of the methods, results could not be quantitatively combined for meta-analysis, and qualitative results are presented in narrative form, according to themes identified from the data. Major themes include capacity of parents to provide informed consent, feasibility of informed consent, support for alternatives to informed consent, process issues, modified consent process, child death, and community consultation. Our review demonstrated that children, their families, and health care staff recognise the requirement for research without prior consent, and are generally supportive of enrolling children in such research with the provisions of limiting risk, and informing parents as soon as possible. Australian data and perspectives of children are lacking and represent important knowledge gaps. (shrink)

The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater number (...) of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. Can there be `peaceful coexistence' between quantum theory and special relativity? Thirty years ago, Shimony hoped that isolating the culprit in proofs of Bell inequalities as Outcome Independence would secure such peaceful coexistence: or, if not secure it, at least show a way---maybe the best or only way---to secure it. In this paper, I begin by being sceptical of Shimony's approach, urging that we need a relativistic solution to the quantum measurement problem. Then I analyse Outcome Independence in Kent's (...) realist one-world Lorentz-invariant interpretation of quantum theory. Then I consider Shimony's other condition, Parameter Independence, both in Kent's proposal and more generally, in the light of recent remarkable theorems by Colbeck, Renner and Leegwater. For both Outcome Independence and Parameter Independence, there is a striking analogy with the situation in pilot-wave theory. Finally, I will suggest that these recent theorems make some kind of peaceful coexistence mandatory for someone who, like Shimony, endorses Parameter Independence. (shrink)

Probabilistic argumentation and neuro-argumentative systems offer new computational perspectives for the theory and applications of argumentation, but their principled construction involves two entangled problems. On the one hand, probabilistic argumentation aims at combining the quantitative uncertainty addressed by probability theory with the qualitative uncertainty of argumentation, but probabilistic dependences amongst arguments as well as learning are usually neglected. People’s decisions and actions are informed, influenced, and constrained by socially constructed social arrangements. Usually, these social arrangements are pre-determined, and people joining institutions or organizations may have, at least initially, little control or influence over them. Occasionally, however, but increasingly commonly in the transition to the “Digital Society,” people have an opportunity to self-determine their social arrangements “from scratch.” The issues then are: how do people gain experience in such founding processes, experiment safely with alternative social arrangements, and gain (...) expertise so that they can participate meaningfully, for example in consultation events. In this research paper, we address these issues by presenting a framework for “computer-supported social arrangements” tools which would enable people to specify, learn, apply, evaluate, and innovate social arrangements. This would contribute to empowering people and communities with the necessary experience, experimentation, and expertise for effective and sustainable self-determination of their own social arrangements. Mild hypoferremia represents an aspect of the ability of the body to withhold iron from pathogenic bacteria, fungi, and protozoa, and from neoplastic cells. However, our iron-withholding defense system can be thwarted by practices that enhance iron overload such as indiscriminate iron fortification of foods, medically prescribed iron supplements, alcohol ingestion, and cigarette smoking. Elevated standards for normal levels of iron can be misleading and even dangerous for individuals faced with medical insults such as chronic infection, neoplasia, cardiomyopathy, and arthritis. (...) We are becoming increasingly aware that the wide-spread hypoferremia in human populations is a physiological response to insult rather than a pathological cause of insult, and that attempts to correct the condition by simply raising iron levels may not only be misguided but may actually impair host defense. Bourdieu's academic work and his political interventions have always proved controversial, with reactions varying from passionate advocacy to savage critique. In the last decade of his career, the French sociologist Pierre Bourdieu became involved in a series of high-profile political interventions, defending the cause of striking students and workers, speaking out in the name of illegal immigrants, the homeless, and the unemployed, challenging the incursion of the market into the field of artistic and intellectual production. South Africa's 1996 Constitution promises a measure of ‘social citizenship’ alongside formal political and legal equality. South Africa's public welfare and social policies may be less effective in ensuring social citizenship, through reducing insecurity and inequality, than those of the more established democracies, but they are far more effective than those of other ‘developing’ countries. The origins of social citizenship in South Africa lie in the early and mid-1940s, when the state first assumed responsibility for the welfare, broadly understood, of (...) all South Africans. The most significant achievement was the introduction of a universal old-age pension system. The importance of these initiatives has been largely overlooked. This has been in part because later scholars largely ignored the heterogeneity of liberal thought in South Africa in the mid-twentieth century, as followers of the ‘New Liberalism’ broke with the classical liberalism of John Stuart Mill and argued for a range of state interventions in social and economic life. In South Africa, as elsewhere, the Second World War provided a context in which revised liberal thought gave rise to major policy reforms, some of which were to survive even the election of a National Party government in 1948. It has become almost commonplace to claim that utilitarianism was, from its inception, an imperialist theory. Many writers, from Bentham’s own followers to recent scholars, have suggested that from Bentham onward, utilitarians reveled in the opportunity that they believed despotic power provided for the establishment of perfectly rational laws and institutions. A closer look at Bentham’s own views on empire, however, reveals a sharp break between his position on European colonies and that of followers such as James and John (...) class='Hi'>Stuart Mill. For Bentham, the utilitarian doctrine led to criticisms of the empires of his day. Bentham is better understood as a participant in the late-eighteenth-century skepticism about imperial conquests and aspirations than he is as a proto-colonialist or a “Solon” of India. Once he is understood in this light, our picture of his successors, especially J. S. Mill, is revised as well. (shrink)

Even for one, individual, singular person, there are potential problelms with Utilitarianism. We must decide whether we go for pleasure, or try to avoid pain. Many other options are available. In addition to maximizing pleasure, we must also think of what the probabilistic likelihood to getting what we want. When weunderstand the problems, we also face the problem of making transitive decisions. Problems with Intransitive decisions take us out of Utilitarian theory. When we add additional people, the problems are still (...) there, but are now elevated. We see there are exact contradictions, and when we add the problems of evaluating,utilitarianism is more difficult than we had expected. Jeremy Bentham's arguments regarding fallibility and infallibility comprise a fundamental and distinctive dimension of his democratic theory. Writing against the assertion of infallibility in religious, political, and legal contexts, Bentham claimed that authorities encouraged a popular belief in their own infallibility as a means of corrupting the people's faculties of judgment. In so doing, rulers were able to secure their own interests against the public welfare and to inhibit the possibility of utilitarian reform. Such arguments may have influenced John (...)
